Governing appropriate behavior and prohibited uses of the Medix Digital Platform

1. Purpose

This Acceptable Use Policy ("AUP") defines the standard rules for using the Medix Digital Service to ensure its reliable, ethical, and legal operation for all clients. Violation of this AUP may result in the suspension or termination of your account.

2. Prohibited Uses

You agree not to use the Service to:

A. Unlawful Activity: Transmit or store any material that is illegal or violates any law, rule, or regulation, including, but not limited to, data privacy, consumer protection, or financial regulations.

B. Unauthorized Communications: Engage in "spamming" or send unsolicited bulk messages (email or text), or use automated dialing features without verifiable, prior express written consent from the recipient, as required by the TCPA.

C. Malware and Harmful Code: Upload, post, or transmit any virus, worm, Trojan horse, or any other code of a destructive or malicious nature.

D. Harassment and Abuse: Engage in conduct that is abusive, harassing, threatening, defamatory, or harmful to any person or entity.

E. Security Violations: Attempt to breach the security of the Service, access data not intended for you, or interfere with the Service's operation (e.g., Denial of Service attacks).

F. Data Misuse (PHI): Collect or transmit any Protected Health Information (PHI) without a fully executed Business Associate Agreement (BAA) in place with Medix Digital.

3. Content and Consent Compliance

3.1 Accuracy: All information you submit to the Service must be truthful and accurate.

3.2 Opt-Out: You must include clear and conspicuous unsubscribe/opt-out instructions in all marketing communications sent via the Service and immediately honor all such requests.

3.3 Data Ownership: You must be the sole and exclusive owner or licensed user of all data you upload to the Service.

4. Enforcement and Remedies

Medix Digital has the right, but not the obligation, to monitor your use of the Service for compliance with this AUP. We reserve the right to suspend or terminate your account access immediately and without refund if we determine, in our sole discretion, that you have violated this AUP.
